I. The following cases are absolute basics:
  1. United States v. Emerson, 46 F.Supp.2d 598 (N.D.Tex. 1999). (by Judge Sam R. Cummings)
    Case of first impression in 5th Circuit. Judge found 2nd Amendment to be individual right based on textual analysis, based on history from English antecedents to drafting of 2nd Amendment, and based on structure of 2nd Amendment within Bill of Rights. Cited Supreme Court in Verdugo-Urquidez (1990) which said "the people" in 2nd Amendment meant the same as in Preamble, 1st, 4th, 5th, and 9th Amendments.
  2. United States v. Emerson, 270 F.3d 203 (5th Cir. 2001). (by Circuit Judge William L. Garwood)
    First federal appellate decision embracing individual-rights view of 2nd Amendment.
  3. Parker v. District of Columbia, 478 F.3d 370 (D.C. Cir. 2007). (by Sr. Circuit Judge Laurence H. Silberman)
    Held that 2nd Amendment's "right of the people" is individual right and that D.C.'s complete ban on registration and carrying of firearms violated 2nd Amendment.
  4. District of Columbia v. Heller, 554 U.S. 570 (2008). (by Justice Antonin Scalia)
    Held that the 2nd Amendment is individual right, unconnected with military service.
  5. McDonald v. City of Chicago, 561 U.S. 3025 (2010). (by Justice Samuel Alito)
    Held that 2nd Amendment is incorporated on states; plurality of four for Due Process, one concurrence for Privileges or Immunities.
  6. Ezell v. City of Chicago, 651 F.3d 684 (7th Cir. 2011). (by Circuit Judge Diane S. Sykes)
    Held that firing ranges are protected under 2nd Amendment.
